AQUASERV Transnational Access Terms of submission

1. Terms​

These Terms and Conditions (together with the documents referred to in it) explain the terms on which you may use the site to submit applications for access to the AQUASERV research infrastructure at the Access Providers. Please read these terms carefully before submitting any content: by submitting an application you indicate that you accept these terms, and you agree to abide by them. If you do not agree to these terms, you may not use the site to make submissions.

2. Change to these terms

AQUASERV may revise these Terms of use at any time, and updates will be added to AQUASERV website and communicated to applicants, if applied to them.

3. Service availability

AQUASERV accepts in principle applications for Transnational Access (TA) to Access Provider from persons employed in any country. However, there may be exceptions and at present applications from researchers from Russian institutions are not accepted. Access from user – or a user group – whose home institution is situated outside the EU or in an Associated Country is limited to a budget corresponding to 20% of the total TA budget provided under the Grant.

4. Application submission

  • To request access to facilities from AQUASERV Access Providers, registration and submission of an application through the web-based application system is required.
     

  • AQUASERV procedure for applications, the criteria for eligibility, evaluation and implementation of successful applications are explained on the AQUASERV website and in detail in the TA Handbook. For further details please contact Stella Alexandroff (stella.alexandroff@embrc.eu)
     

  • By submitting an application, applicants represent and warrant they are affiliated with an accredited scientific institution, university or company and that the application contains only information that is true, accurate and complete.
     

  • By submitting an application, the applicant(s) grant(s) AQUASERV a revocable and non-exclusive license to reproduce, modify, prepare derivative works of and otherwise use and disclose the content for the purposes of evaluating the application and assessing the feasibility of conducting the proposed research at the requested facility.
     

  • AQUASERV will use its reasonable endeavors to keep applications confidential and will only disclose applications to those third parties for whom it considers reasonably necessary to perform the evaluation described BEFORE or where required by law.
     

  • Applicants will be informed of the outcome by email. User names and Access Providers of successful applications will be displayed on the AQUASERV website in the public domain, and may be shared with funding bodies on request.

5. On-site access

  • User status does not convey any entitlement to statutory health, nursing care, accident, unemployment or pension cover. Full health-, travel- and personal accident insurance is obligatory. It must cover the full period from arrival to departure. It is strongly recommended that User(s) should arrange adequate insurance cover prior to traveling.
     

  • The Access Provider’s management reserves the right to cancel or reschedule visits.
     

  • When using Access Provider facilities, the User shall comply with their regulations, including health and safety requirements, presented to the researcher at arrival. The visiting researcher shall be subject to the authority of the Access Provider management.
     

  • The visiting researcher shall treat the Access Provider facilities with due care and protect these against loss or damage.
     

  • The institution hosting a User shall bear responsibility for ensuring the agreed work or service is delivered in accordance with the regulatory and safe working practices required by the host institution, including ensuring appropriate permissions and training are ready before the start of work. The Applicant must specify permit and license requirements in the application. If the application is approved, the TA may take place once the permits are granted and AQUASERV is still active. AQUASERV shall not be liable for any accidents or infringements arising during on-site access.
     

  • Outcomes of TA supported by AQUASERV project must acknowledge AQUASERV as follows: “Funded by the European Union under grant agreement No 101131121, AQUASERV project”. Copies or links of such publications must be sent to aquaserv@ualg.pt to be stored in the AQUASERV Open Access Repository.
     

  • At the end of TA visit, the User is required to submit a reimbursement claim and to provide the requested documents as specified in the provisions of the User Access Contract.

6. Submission of applications

  • Where you are required to complete a registration form in order to access restricted parts of the site or specific services, you agree to:

    • provide true, accurate, current and complete information; and

    • to maintain and promptly update your user profile to keep it true, accurate, up-to-date and complete.
       

  • If AQUASERV has reasonable grounds to suspect that any information supplied is untrue, inaccurate, out-of-date or incomplete, it reserves the right to suspend or terminate your registration and any access you may have to restricted parts of the site or any and all services.
     

  • Other than the limited license set out in POINTS 5, 6 and 7 (as applicable), AQUASERV acknowledges and agrees that it obtains no right, title or interest from you (or your licensors) under these Terms of submission in or to any content that you submit, including any intellectual property rights which may subsist in that content (whether those rights are registered or not, and wherever in the world those rights may exist). You acknowledge and agree that you are responsible for protecting and enforcing those rights and that AQUASERV has no obligation to do so on your behalf.
     

  • You acknowledge that:

    • you have received good and valuable consideration in exchange for the applicable license and that you are not entitled to any further compensation for any use by AQUASERV of the content in accordance with that license; and

    • AQUASERV may, without notice to you, reject, refuse to use or delete any content at any time where it considers this to be reasonably necessary.

7. Data management policies

AQUASERV has a Data Management Plan that is for public consultation.
 

AQUASERV requires that all datasets and publications produced with AQUASERV TA funding Open Access. This includes data and publications produced by the TA users.

8. Privacy policy

Personal data relating to your proposal submission will be stored securely according to General Data Protection Regulation (GDPR) and will be used for the purposes of processing your application, peer review, communications and managing the services. Details of the name and Home Institution country for successful candidates will be published online ON the AQUASERV website. Full details are given here (Privacy policy).
